A West New York man made his first court appearance on August 11 on charges he had 160 Xanex pills on him with intent to distribute the prescription drug, and also had a large number of oxycodone and methadone pills, officials said.
Bail was set at $25,000 cash or bond for Fernando M. Fonseca, 41, of the 500 block of 51st Street, when he appeared in Central Judicial Processing court in Jersey City via video link from Hudson County jail in Kearny.
CJP Judge Margaret Marley also told Fonseca there were a number of warrants for his arrest out of Union City Municipal Court. She said the warrants appeared to be for parking violations and there was one with a bail of $1,979 and others with bails of $550.
Even if he posts bail, Fonseca will not be released because Immigration and Customs Enforcement has put a hold on the Nicaraguan native, court officials said.
Fonseca has one prior arrest and one disorderly persons conviction, court officials said. He faces five to 10 years in prison if convicted of the charges.
